In certain cases, after a formal review of a client's credentials and supporting documentation, our firm may offer a conditional fee structure for select NIW petitions.
Important Clarifications:
This option is not available for all cases. Eligibility is determined at the firm's discretion after credential review. The determination to offer this structure does not constitute a guarantee of approval. Immigration adjudications are discretionary and depend on multiple factors, including evidence, legal standards, and USCIS review.
If a case accepted under this specific engagement structure is denied after full adjudication of the I-140 petition, attorney fees paid under that agreement may be refunded in accordance with the written engagement agreement. Government filing fees, premium processing fees, expert fees, translation fees, and third-party costs are not refundable.
The precise terms, conditions, scope of representation, and refund mechanics are defined exclusively in the signed engagement agreement.
Alternative Engagement Option
Clients may also elect a standard fee arrangement that does not include the conditional refund structure. The scope and fee terms for each engagement type will be described in writing before representation begins.
