NIW FAQ for STEM professionals

Can I file NIW while on F-1 OPT or STEM OPT?
Yes. Filing the I-140 NIW petition does not affect your F-1 status. It's a common strategy to file early during OPT or STEM OPT to lock in your priority date. The I-485 adjustment of status is filed later when your priority date becomes current.
What if I don't win the H-1B lottery?
NIW is independent of the H-1B lottery. It's a self-petitioned green card pathway that doesn't require employer sponsorship or a visa lottery. Many clients file NIW as a primary strategy or as a backup to the H-1B lottery.
Do I need a PhD to qualify?
